Child Custody While Separated

Child Custody During Separation is based upon the best interest of the child and may require a parenting plan that both spouses must agree upon. If they cannot agree then the court will determine custody and visitation. Parenting plan agreements take the parents schedules into consideration but are mostly determined around the child's schedule. There is less disruption in children's lives if they are not moved out of their home or schools. Even if the parents agree the court may not if kids are uprooted unnecessarily during a separation. Putting the needs of the babies ahead of oneself is an expectation of the court and must be carefully considered with child custody during separation. "But Jesus said, Suffer little children, and forbid them not, to come unto Me: for such is the kingdom of heaven" (Matthew 19:14).

The primary caregiver is usually the parent who receives child custody during separation. This causes less disruption to the children and lessens the pain of divorce, at least a little. Divorce can be devastating to the partners so imagine what it must be like for the kids. Kids love both parents and do not want to be away from either one. Anything that can be done to lessen the pain associated with a separation the better for everyone involved. Couples might even consider continuing to live together but stay in separate bedrooms until marital issues can be resolved. If this is not possible then consider living in the same vicinity so that the kids can see both parents as often as possible.

When adults separate there is a need for them to set up visitation for the partner who is going to move out. Child custody during separation can be set up with joint custody between parents as long as the kids are not moved out of their schools. The partner who moves needs to have a residence close by. Children will need their own bedrooms. They need a roof over their heads, comfortable clothes to wear, good food to eat, and a lot of love. The court will probably order that the parent who has visitation cannot take them out of the area for any reason or at least without the other parent's consent.

Financial matters are very important with child custody during separation. The main financial matter is going to be taking care of the kids during this difficult change. Parents can share this responsibility as fairly as possible. If the father has been the sole provider and he leaves then there will be a need for him to continue to support the children during the separation. If this is the case then he may be required by the court to provide spousal support as well. However, if the mother has been working as well then the responsibility of providing financial support will be shared. And of course there is always the possibility that the father has been the primary caregiver and the mother works outside the home. If this is the case then the roles would be reversed where Mom provides the financial means to ensure the kids are taken care of.

A separation agreement will help to define other matters around child custody during separation. Other matters include division of property and division of debts. The primary caregiver is normally the one who keeps the home, at least temporarily. However, the questions of who will make the house payment and who will pay the bills are important considerations and must be taken care of when the partners split up. In reality, all of these things should be considered long before the couple separates. But in many cases this does not usually happen. Usually the partners have a fight and one leaves. If this describes your situation then ask your spouse to sit down with you and discuss the particulars. Otherwise a temporary court order will dictate exactly how things are going to be handled and how the kids are going to be taken care of.

Responsible adults might want to anticipate the needs of the children by seeking a child psychologist or counselor. This may be a necessity if the kids are having difficulty with the new arrangements around child custody during separation. Behavior problems at home and at school are indicators of coping difficulties. Parents should never be so caught up in their own feelings and emotions that they do not notice how the kids are dealing with all the changes. Imagine your life being totaled turned upside down because there is an absent parent and now there are two homes instead of one. There is a high probability that kids will blame themselves for the breakup. Remember kids do not understand all the complexities of life. They have not experienced life yet, at least not like their parents have. Kids need guidance and lots of reassurance.

The best way to find out about child custody during separation is to consult with a family law attorney. Write down a list of questions before you go. There is also a lot of information on the Internet but remember that laws vary by state. Get some advice on how a breakup affects children. Reconciling with the other partner is possible if couples are willing to try. Marriage Therapists, Christian Counselors, Couples Retreats, are all ways that couples can seek answers for their problems. Pray together, go to church, learn to be thankful for what you have, and refuse to give up on the other person. Work together to solve problems and most of all put the babies first by considering what is best for them.
